Ocean Prosperity Company Limited (“Ocean Pro”) respects personal data privacy and is committed to implement and comply with the data protection principles and provisions under the Cap. 486 Personal Data (Privacy) Ordinance (“PDPO”). This privacy policy & cookies (“Policy”) describe how Ocean Pro treats personal information we may collect from you in the context of your relationship with Ocean Pro, including on www.oceanpro.com.hk and mobile applications managed by Ocean Pro that incorporate this policy.

We take our responsibility to protect the privacy and confidentiality of your information, including personal information, very seriously. We maintain physical, electronic and procedural safeguards that comply with applicable legal standards to secure such information from unauthorized access and use, accidental or unlawful alteration and destruction, and other unlawful or unauthorized forms of Processing. We hold our teams, employees and accountable for complying with relevant policies, procedures, rules and regulations concerning the privacy and confidentiality of information.

What Information We Collect

The types of information we collect from you when you visit or use our online services include personal and contact details, such as your name, email address, mailing address, telephone number(s), account numbers, limited location information, user name and password. We may also collect payment card information, identity card number, social security number, driver’s license number (or comparable), gender, race, nationality, and biometric identifiers when you provide it directly to us while using our online services and where we believe it is reasonably required for ordinary business purposes. In some instances, we create personal information about you, such as records of your interactions with us, and details of your accounts. We do not seek to collect or process sensitive personal information unless it is required or permitted by law; necessary for the detection or prevention of crime; necessary to establish, exercise or defend legal rights; or we have your prior explicit consent.

In addition to the personal information described above, we collect certain information about your use of our online services. For example, we capture the IP address of the device you use to connect to the online service, the type of operating system and browser you use, and information about the site you came from, the parts of our online service you access, and the site you visit next. We and our third-party partners use cookies (as well as web beacons or other technologies) to collect and store this and other information about your visit to, or use of, our online services. We may use information we obtain for the following legitimate business purposes:

communicating with you and processing inquiries and complaints; enabling you to participate in our events; establishing and managing our business relationships; operating, evaluating, and improving our business (including administering the Platforms; troubleshooting technical -issues; developing new, and enhancing and analyzing our offerings; managing our communications; performing data analytics; and performing accounting, auditing and other internal functions); maintaining and enhancing the safety and security of our platforms, offerings and preventing misuse; verifying your identity and preventing fraud and other criminal activity, claims and other liabilities, including performing anti- money laundering due diligence activities; exercising our rights and remedies, responding to requests from government entities, and defending against legal claims; and complying with and enforcing applicable industry standards and Ocean Pro policies.

Subject to applicable law, we use information for these purposes based on your consent or because we have a legitimate business interest. We also may process information where it is necessary to comply with our legal requirements and regulatory obligations.

Where we have a contract with you, we process information as necessary to perform our contractual relationship with you, provide our offerings, and manage our relationships. We may also use information in other ways for which we provide specific notice at the time of collection.

We May Share Information With Third Parties

We may share information within the Ocean Pro family of companies and with third parties for purposes described in this Notice and in accordance with applicable law. Such third parties include:

(1) service providers including internet service providers, operating systems and platforms, and IT support vendors;
(2) professional services organizations, such as auditors and law firms;
(3) our customers, and business partners; and
(4) social media platforms if you use those services to connect with us.

We also may disclose information (a) if we are required to do so by law or legal process, such as a court order, regulatory reporting requirement or subpoena, which may include lawful access by Hong Kong or foreign courts, law enforcement or other government authorities; (b) in response to requests by government agencies, such as law enforcement authorities; (c) to establish, exercise or defend our legal rights; (d) when we believe disclosure is necessary or appropriate to prevent physical or other harm or financial loss; (e) in connection with an investigation of suspected or actual illegal activity; (f) in connection with a potential or actual sale or transfer of all or a portion of our business or assets (e.g., in the event of an acquisition, merger, reorganization, dissolution or liquidation); or (g) otherwise with your consent or as directed by your representative.

How Long We Retain Information

We will retain your personal information for the period reasonably necessary to achieve the purposes set out in this Privacy Notice (or any other notice provided at the time of collection) and our legal obligations, taking into account applicable statutes of limitation and records retention requirements under applicable law.

We May Link To Third-Party Sites Or Services We Don’t Control

If you click on some links on our Platforms, you will be taken to websites we do not control. This Notice does not apply to the privacy practices of those websites. We are not responsible for these third-party sites or services.

What We Will Do If There Is An Update To This Policy

From time to time we may update this Policy to reflect changes in our privacy practices. We will notify you of material changes to this Policy as required by law. We will also post an updated copy on our website and indicate at the top of the Policy when it was most recently updated. Please check our site periodically for updates.
